Transfer of Cal State Fullerton Killer to Napa State Hospital Angers DA, Victims’ Relatives

A janitor who opened fire on his colleagues at Cal State Fullerton four decades ago, killing seven of them, has been quietly transferred from a state hospital in San Bernardino to a less secure one in Northern California, according to Orange County’s top prosecutor, who is outraged by the move.

Standing with relatives of two of the victims of Edward Charles Allaway, now, 77, District Attorney Tony Rackauckas said Friday he believed the transfer was a precursor to Allaway’s release from custody.

"Patton State Hospital inexplicably, without any notice to the DA, or without any notice to Allaway’s victims, unilaterally transferred Allaway to this state hospital in Napa. Why?” Rackauckas said. “Are they trying to quietly recommend his release? It looks like it.”

Allaway was transferred from Patton State to Napa State Hospital two weeks ago, Rackauckas said.

Allaway was working as a custodian at the college campus when he brought a recently purchased rifle to the library and shot nine people, killing seven of them, on July 12, 1976.

Before the Seal Beach salon massacre in 2011, in which Scott Dekraai fatally shot his ex-wife and seven other people, the Cal State Fullerton shooting was the deadliest in Orange County history.

Last month, a candlelight vigil was held to mark the 40th anniversary and remember those killed.

Allaway had a history of mental illness, but no one on campus knew that at the time of the mass killing, Deputy District Attorney Dan Wagner recalled at the time of the vigil.

Allaway believed his coworkers were plotting a bizarre pornographic conspiracy involving his wife. He “rather methodically” hunted down his coworkers and shot them, Wagner said.

At his trial, the judge determined Allaway was not guilty by reason of insanity and was criminally insane. He was committed.

After many years at Atascadero State Hospital, he was transferred to Patton State Hospital, a minimum-security institution, the Los Angeles Times reported last month.

Allaway has tried repeatedly to secure his release, arguing he has been cured. Hospital staff have supported his efforts through five petitions, Rackauckas said.

The district attorney called the Napa facility “idyllic,” saying Allaway could easily walk to a nearby road in 10 to 15 minutes if granted ground privileges.

There’s no legal requirement that the DA’s office or victims be notified of Allaway’s movement within the state hospital system, Rackauckas acknowledged. But he said he had written a letter to Gov. Jerry Brown and the heads of Patton and Napa state hospitals in hope of having a discussion on their policies.

Paul Paulsen, brother of Allaway victim Deborah Paulsen, who was a 26-year-old graduate student when she was killed, said he had mourned and endured the repeated release petitions for 40 years.

He objected to Allaway’s being moved to Napa, and to the lack of notification.

“This, in my mind, is a reprehensible action and eventual threat to me personally as well as our local communities,” Paulsen said. “God help us all if he is every released in any way, shape or form.”


Driver Gets 1 Year in Jail in Hit-and-Run Crash That Killed 55-Year-Old Cyclist in Laguna Beach

A 21-year-old Newport Beach man was sentenced to one year in jail Monday for killing a 55-year-old cyclist and fleeing the scene of the crash in 2014.

Dylan Thomas Rand-Luby, pleaded guilty to one felony count of hit-and-run with injury and one misdemeanor county of vehicular manslaughter without gross negligence, the Orange County District Attorney’s Office announced.

Rand-Luby killed cyclist John Colvin when he swerved his 2005 Toyota Prius into a bike lane along North Coast Highway in Laguna Beach on June 17, 2014, striking Colvin.

With a shattered windshield, Rand-Luby continued driving, leaving at the edge of the roadway. Rand-Luby was followed by two witnesses until he stopped about a mile away in an elementary school parking lot, where he was questioned by responding police.

Colvin died at the scene from blunt force trauma, the DA’s office said. His family members read statements at court in Santa Ana Monday.

“The loss is so deep and massive it truly is impossible to explain. John represented everything that is good in life; to his very core he was kind, loving, gentle, strong, forgiving and empathetic,” his wife said.

His parents said they’ve been told time heals, but “we have not felt any healing in the last 15 months.”

Rand-Luby had faced up to four years in state prison, the DA’s office said in February 2015, when he was charged.

He was sentenced Monday to one year in jail and three years of formal probation.

Rand-Luby’s last name was previously provided by the DA’s office as Randluby. He was 19 at the time of the crash.

Santa Ana Man Charged With Involuntary Manslaughter After Shooting Teen Inside Home

A Santa Man was charged with involuntary manslaughter on Thursday after shooting a 16-year-old in his home, according to the Orange County District Attorney’s office.

Matthew Jacob Granados, 21, was charged with one felony count of involuntary manslaughter by lawful act in an unlawful manner with a sentencing enhancement for the personal use of a firearm.

Granados was allegedly in his room in his home on Hazard Street with the victim, Alex Ramirez, around 11:30 p.m. on Sept. 4. He is accused of handling a firearm in a careless manner, resulting in a single shot being fired into Ramirez’s torso, according to police.

Ramirez, a known skater in the community, died from his injuries.

Witnesses initially told investigators there had been a drive-by shooting, providing a description of the car, according to Santa Ana Police Department Cpl. Anthony Bertagna.

But police determined that story was a lie, and detectives obtained a search warrant for the home, Bertagna said. Inside, they found evidence in a bedroom that led them to believe it was the scene of the shooting, according to the corporal.

Granados fled the scene after the shooting and his father, Alexander Christopher Granados, is accused of making misleading statements to the police in order to help his son avoid arrest.

The elder Granados, 41, was charged with one felony count of being an accessory to involuntary manslaughter after the fact and is being held on a $25,000 bail.

Matthew Granados turned himself in to the Tustin Police Department on Sept. 6 and was transported to the SAPD.

He is being held on a $75,000 bail and faces a maximum sentence of 14 years in state prison.

Former Dana Hills H.S. Teacher, Baseball Coach Sentenced to 5 Years in Prison for Child Pornography, Sexually Assaulting Young Teen

A former high school teacher and baseball coach was sentenced on Thursday to five years in state prison after pleading guilty to child pornography and sexual assault charges, according to the Orange County District Attorney’s office.

Ezequiel Christopher Barragan, 50, of Aliso Viejo pleaded guilty to four felony counts of performing lewd acts on a child under the age of 14, three felony counts of lewd acts on a child between the ages of 14 and 15, and one felony count of possession of child pornography.

Barragan was a Spanish teacher at Dana Hills High School in Dana Point and a youth baseball coach at the time the crimes occurred.

He was also a volunteer with Court Appointed Special Advocate (CASA) for Children in Orange County, where he was in contact with child and teen victims of abuse and neglect. It was during Barragan’s time as a CASA volunteer that he first encountered the victim, officials said.

Between August 2012 and February 2015, Barragan sexually assaulted the teen, identified as John Doe, who was between the ages of 13 and 15, according to prosecutors. The boy was not a student at Dana Hills High School.

Barragan possessed child pornography for two months in 2015, including nude images depicting boys between the ages of 12 and 16, police said.

Barragan’s crimes were first discovered by a U.S. Postal Inspection Service agent. The agent contacted the Orange County Child Exploitation Task Force, who investigated this case.

Barragan must register as a sex offender for the rest of his life, in addition to his prison sentence.

O.C. Man Sentenced to Life in Prison for Rape of Preteen Girl That Led to Pregnancy: DA’s Office

A 40-year-old Santa Ana man accused of forcibly raping a preteen girl and getting her pregnant has become the first person to receive a life sentence in an Orange County sexual assault case, prosecutors announced Friday.

Demetrio Rojas Perez was convicted in June on four felony counts of aggravated sexual assault of a child under 14 and one felony count of forcible lewd acts on a child under 14, the Orange County District Attorney’s Office said in a news release.

The jury also found true sentencing enhancement allegations that the defendant inflicted bodily harm on a victim under the age of 14 and personally inflicted great bodily injury during the commission of the crime for which he was convicted.

Perez, who was “in a position of trust” with the young victim, began sexually assaulting the girl when she was just 12 years old, including forcibly raping and digitally penetrating the preteen, according to prosecutors.

The girl screamed and attempted to fight back, but Perez covered her mouth and threatened to kill her and her family if she reported the incident, the release stated.

The numerous attacks took place over a period of seven months, and in mid-2014, the victim discovered she was pregnant, according to prosecutors. At that point, she contacted authorities and the Santa Ana Police Department began an investigation.

DNA evidence confirmed Perez impregnated the victim, the DA’s office said.

Perez is the first person in an Orange County sexual assault case to receive a life sentence in state prison without the possibility of parole.

He received the sentence under California’s One Strike Law. The law, enacted in 1994, was amended in 2010 to add a mandatory life sentence in prison “if certain underlying forcible sex crimes are committed against a minor victim with one or more of the enumerated ‘major’ factors or two or more of the enumerated ‘minor’ factors,” the release read.

In Perez’s case, the qualifying factors were forcible lewd acts on a child under the age of 14 and the sentencing allegations of bodily harm, according to the DA’s office.

Suspected Pimp Accused of Trying to Kill 1 Woman, Threatening Another Woman at Anaheim Motel: OCDA

A man suspected of being a pimp was arrested last week for allegedly threatening two women, and trying to drown one of  them in an Anaheim motel, the Orange County District Attorney’s Office reported Monday.

Deandre Henderson, 26, of Tustin was arrested on Sept. 22 and faces charges of one charge each of felony attempted murder, felony assault with force likely to produce great bodily injury, felony first degree residential burglary, felony pimping, and two felony counts each of criminal threats and pandering, the DA’s office reported in a news release.

Henderson is accused of pandering a woman from Washington, and pimping, pandering and keeping money received by another woman who was for paid sexual acts in area known for human trafficking and commercial sex between July 1 and July 17, prosecutors stated.

Henderson is also accused of threatening to kill both women between Aug. 17 and Sept. 17, according to the OCDA.

On Sept. 17 Henderson is alleged to have punched one victim, pulled her hair and attempted to hold her face underwater in a bathtub until she started to lose consciousness inside a motel bathroom in Anaheim, the DA’s office reported. Before fleeing he allegedly stole her purse and cell phone.

A  motel employee noticed the victim running partially clothed through the parking lot and called police.

Henderson fled the scene, but was arrested a few days later at his Tustin home.

If convicted Henderson faces a maximum sentence of life in state prison.

Henderson is scheduled to return to court on Oct. 26.

 

Twentynine Palms Woman Charged With Abusing 3 Children, Forcing Them to Engage in Sexual Acts With Each Other

A woman was charged with sexually abusing children by forcing them to commit lewd acts on each other in front of her, officials said Thursday.

Brandi Alma Valadez, 40, faces six felony charges, according to the Orange County District Attorney’s Office: two counts of lewd acts on a child under 14, two counts of forcible lewd acts on a child under 14 and two counts of child abuse, with a sentencing enhancement for multiple victims.

Valadez was arrested Wednesday in Twentynine Palms but has lived in various cities, authorities said.

The charges involve two boys under the ages 10 and 13 and one girl under the age of seven, all of whom knew the suspect, according to a statement from the DA.

Valadez is accused of forcing one of the boys and the girl to engage in sexual acts with each other, and of sexually assaulting the young girl herself. She was also allegedly aware that the second boy had committed sexual acts on the girl.

The crimes took place in August 2014, the DA said. Police were made aware of the accusations after two of the children reported the assaults to family members.

If convicted, Valadez faces a maximum sentence of life in state prison. She is being held on $1 million bail and will next appear in court Nov. 4.

Man Sentenced to Prison in 2014 Fatal Stabbing in Stanton Parking Lot

A man was sentenced to 26 years to life in prison in connection with the stabbing death of another man in a Stanton parking lot two years ago, the Orange County District Attorney’s Office announced Friday.

Daniel Perez Munoz, 23, was found guilty of the Jan. 2014 incident on Aug. 16, 2016.

Munoz was drinking with friends in an apartment parking lot when he walked to another parking lot and approached Phuong “Bob” Huynh, 52, who was walking to a store. Munoz then stabbed him several times in the neck and chest. Huynh took a few steps before he collapsed and died at the scene, officials said.

Munoz ran away from the area and was arrested by Garden Grove Police Department officers at his home about an hour after the incident.


Man Sentenced to Life in Prison for Murdering Sleeping Parents, Attempted Murder of 2 Siblings in O.C. Mansion

A man was sentenced Friday to life in prison without the possibility of parole in the 2014 shooting murder of his parents while they slept in their San Juan Capistrano mansion, and the attempted murder of his two siblings – including his 8-year-old brother who was left paralyzed, officials announced.

Ashton Colby Sachs, 22, pleaded guilty on Sept. 20 to two counts each of murder and attempted murder for the Feb. 9, 2014 shooting spree at his family’s multimillion-dollar home on Peppertree Bend, the Orange County District Attorney’s Office reported.

On Friday Sachs was sentenced to consecutively serve two life terms without parole, two life terms, three indeterminate terms of 25 years to life, and 30 determinate years in state prison, the DA’s office said.

Sachs was a 19-year-old college student living in Seattle when his parents, Bradford, 57, and Andra Sachs, 54, were shot to death. Investigators said Sachs drove to San Juan Capistrano early on the morning of the slayings with a plan to kill his family.

Upon arriving at the home, Sachs entered his parents’ bedroom and shot them multiple times. He then continued to his 8-year-old brother’s room and fired more shots. The little boy survived the shooting, but was left paralyzed, officials said.

Sachs also went into his 17-year-old sister’s room and fired a shot, but she was not struck.

Sachs took a plane back to Seattle after the shootings. He was arrested a month later following police interviews.

Ex-Teacher Convicted of Sexually Assaulting 13-Year-Old Girl Slits His Throat in Santa Ana Courtroom

A former teacher accused of raping a teen girl slit his throat in a Santa Ana courtroom Wednesday morning after a jury convicted him on multiple accounts of sexual assault, the Los Angeles Times reported.

Jeffrey Scott Jones, of Huntington Beach, was found guilty of two counts of aggravated sexual assault of a child and a single count of continuous sexual abuse, according to a news release from the Orange County District Attorney’s Office. All the charges were felonies.

The 56-year-old man apparently produced a small razor blade around 11 a.m. and cut his throat while the verdict was being read, Jones’ attorney, Edward Welbourn, and Orange County Deputy District Attorney Heather Brown told the Times.

Jones, who was screaming and bleeding from his neck, was rushed to a hospital in unknown condition after medical personnel tried to stop the bleeding, according to Brown and Orange County Sheriff’s Department Lt. Mark Stichter

Welbourn described the bleeding as “profuse.”

The injuries were not life-threatening, Stichter told the Times.

His attorneys told the newspaper they did not know how he obtained the razor blade; the lieutenant only confirmed that Jones had used some type of “cutting instrument.”

How he brought that instrument into the courthouse will be the subject of a Sheriff’s Department investigation, according to Stichter.

Jones taught for 27 years at Bell High School in Bell and Gahr High School in Cerritos, the DA’s release stated. The victim was not one of the defendant’s students.

He was working as an advanced placement English teacher at Libra Academy in Huntington Park when the crime occurred, according to prosecutors.

Jones started abusing the victim when she was in the eighth grade, Brown said during the trial, according to the newspaper. He first made sexual comments, before beginning to inappropriately touch her in the fall of 2012,  Brown told the Times.

Jones raped her the following spring, when the victim was just 13, according to the DA’s office.

“On May 4, 2013, and May 9, 2013, Jones raped the victim, stating that he would ruin her life if she told anyone what he was doing,” the release stated. “The victim went to a friend’s home and the defendant went to get her. The friend’s mother refused to allow the defendant to take Jane Doe.”

The investigation into the case began in May, and Jones was arrested late in June.

“During the trial, a female relative of the victim testified for the defendant and gave an alternative explanation as to how the defendant’s semen was found inside of the victim’s cervix. In rebuttal, evidence was introduced that the defendant had sex with two minor former students for an extended period of time,” the release said.

Jones faces a maximum sentence of 68 years to life in state prison when he returns for sentencing on Nov. 4, according to prosecutors.

Laguna Niguel Man Arrested for Trespassing After Daredevil Videos Gained Attention on YouTube

Laguna Beach detectives arrested a 28-year-old man Wednesday after he allegedly trespassed at a residence and hotel in Laguna and Newport Beach to shoot videos of himself performing stunts, officials said.

Laguna Niguel resident Anthony Booth Armer posted several videos of himself jumping from rooftops and cliffs to YouTube as "8Booth," according to a statement from the Laguna Beach Police Department.

He was charged Tuesday with two misdemeanor counts of unauthorized entry of a dwelling and one misdemeanor count of trespassing with intent to interfere with business, the Orange County District Attorney Office said.

The YouTube account's profile describes the user as an "adrenaline junkie" who seeks to "jump record-breaking jumps" and "skate at record-breaking speeds."

The most recent video was published Oct. 20.

In the most recent incident, Armer is accused of entering the Newport Towers condo building on West Coast Highway on Oct. 6, running up several flights of stairs and jumping from the roof to the harbor below.

Armer is also accused of climbing into a restricted area of the Surf and Sand Hotel in Laguna Beach on Sept. 29 and jumping into the guest pool. A video depicting such a jump, posted by 8 Booth Oct. 14, has more than 6 million views.

And a video posted to YouTube Aug. 30 showing a plunge into the ocean near Table Rock Beach was created July 21 when Armer trespassed at a gated residence in Laguna Beach, police said.

Police said they obtained a warrant for Armer's arrest after the videos garnered attention online.

Armer's arraignment date has not been determined, authorities said.

Naked Man Who Attacked 75-Year-Old Woman and Small Dog in Irvine Sentenced to 10 Years in Prison

A man who was naked when he violently attacked a 75-year-old woman and her small dog while they were out for a walk in Irvine, has been sentenced to 10 years in prison, the Orange County District Attorney’s Office reported on Friday.

Craig Andrew Ledbetter, 52, was sentenced to 10 years in state prison after he pled guilty to one felony count of attempted murder, one felony count of elder and dependent adult abuse, one misdemeanor count of animal cruelty, one misdemeanor count of resisting and obstructing an officer and sentencing enhancements for great bodily injury.

According to police, on the afternoon of Sept. 29, 2015, Sara Hurtado was walking her small dog on Rockwood Street in Irvine when Ledbetter screamed at her and pushed her to the ground.

Ledbetter got on top of Hurtado and punched her in the face and chest, and repeatedly kicked her in the head, prosecutors said.

Ledbetter then attacked Hurtado’s small dog, grabbing the dog’s leash and swinging the dog over his shoulder.

Witnesses called 911 and officers from the Irvine Police Department responded to the scene.

Ledbetter resisted officers, but was subsequently arrested after officer used a Taser to take him into custody, officials said.

Hurtado suffered several injuries including bleeding in the brain, a dislocated arm and eye injuries, prosecutors reported.

The dog was not injured in the attack.

Police said Ledbetter and Hurtado did not appear to have known each other.

A motive for the assault was unknown.

Uber Driver Charged With Raping Unconscious Teen Passenger in Laguna Beach: DA

A Uber driver has been charged with raping a 17-year-old female passenger who was unconscious on a ride back to her Laguna Beach home, the Orange County District Attorney’s Office announced Wednesday.

Samer Alaaeldin Mahran, 23, Huntington Beach was charged Tuesday with one felony count of rape by use of drugs, one felony count of forcible oral copulation upon a minor over 14 years of age, one felony count of sexual penetration of a child over age 14 by foreign object and force, and one felony count of unlawful sexual intercourse.

He was giving the victim a ride home from a Huntington Beach bar when he allegedly assaulted her after parking near her home, the DA’s office said.

A family member ordered the girl an Uber ride home about 2 a.m. Saturday, Nov. 5. When she didn’t arrive home at the expected time, another relative used Uber’s tracking featured to find Mahran’s car, which was parked near the victim’s home.

The relative found the victim and Mahran in the back seat of the vehicle, the DA’s office said. When the relative helped the victim out of the car, Mahran allegedly climbed back into the driver’s seat and fled.

The family member called 911. Laguna Beach police used a description of the assailant, the car’s license plate number and Uber driver profile to arrest Mahran later Saturday.

Police announced the arrest on Tuesday, saying investigators had worked with Uber to identify the driver.

Mahran knew the victim was 17 and unconscious due to intoxication when he raped her, the DA’s office alleges.

The suspect posted $100,000 bail and was released early Wednesday morning.

His arraignment is set for Dec. 2 in Santa Ana.

Former NBA Star Dennis Rodman Facing Criminal Charges in July Hit-and-Run in Santa Ana: DA

The five-time NBA champion is charged with four misdemeanors after driving on the wrong side of a freeway, being involved in a hit and run, not having a valid license and lying to police, according to the Orange County District Attorney.

The incident happened in June in Santa Ana, California, when the former basketball player allegedly drove head-on toward another vehicle while on the wrong side of the freeway. The other driver swerved to avoid Rodman’s SUV and crashed into a concrete wall.

Rodman did not exchange information with the victim, authorities said. He fled the scene before the California Highway Patrol arrived, according to the district attorney’s office.

Police said Rodman could face up to two years in jail if convicted. He is scheduled to be arraigned January 20 in Santa Ana.

“We agree that if anything, this is a misdemeanor traffic matter, and certainly not a felony,” said Darren Prince, a representative for Rodman. “We appreciate the district attorney’s evaluation and know that it should resolve successfully when all facts are considered.”

This is not the first time the basketball Hall of Famer has faced the law.

In 2000, Rodman was sentenced to probation and required to attend an alcohol program after pleading guilty to driving under the influence.


Woman Sentenced to 1 Year in Jail for Impersonating Ex-Boyfriend on Facebook, Sending Herself Threats: OC District Attorney

Orange County officials sentenced a woman to one year jail Wednesday after investigating statements she made while falsely accusing her ex-boyfriend of stalking her and making criminal threats on Facebook, charges for which he was arrested four times, authorities said.

Las Vegas resident Stephani Renae Lawson, 25, was living in Lake Forest when she created a Facebook account impersonating her ex-boyfriend, using it to send numerous threats to her own account, according to a statement from the Orange County District Attorney’s Office. Although charges were initially filed against Lawson’s ex-boyfriend, an investigation into her claims led her to be convicted of one felony count of false imprisonment by menace, violence, fraud or deceit, and one felony count of perjury, prosecutors said.

Lawson’s ex-boyfriend was arrested four times between September and December last year after she filed multiple police reports with the Orange County Sheriff’s Department stating he had violated a restraining order, stalked her and threatened to kill her via Facebook, officials said.

Lawson again used the fake account to send herself more threats in the two days ahead of her ex-boyfriend’s May 5 preliminary hearing, where she testified he had sent the messages, according to the DA’s office.

Authorities decided to conduct a follow-up investigation into Lawson’s statements on the witness stand and, because she had used her own devices and internet provider address, determined her ex-boyfriend was the true victim, prosecutors said. The charges against him have been dropped.

Lawson was charged and arrested on Sept. 28 in Las Vegas.

A former youth pastor at a Lake Forest church was sentenced to two years in state prison Friday for the sexual battery of four young female members of the church.

Sean Patrick Aday, 39, Lake Forest, must also register as a sex offender for the rest of his life, the Orange County District Attorney’s Office announced.

Aday, who was a youth pastor at Grace Community Church at the time of the crimes, pleaded guilty Nov. 4 to two felony counts of sexual battery by restraint and two misdemeanor counts of sexual battery. The victims were adults, in their late teens to early 20s, the Orange County Sheriff’s Department said when deputies arrested Aday last year.

He sexually touched two women against their will between Nov. 30, 2015, and Aug. 1, 2015. Two other women were restrained while he sexually touched them between Jan. 1, 2008, and Nov. 6, 2015, the DA’s office said.

“You were an authority figure and you abused that. You tried to use God to manipulate me,” one victim said in court. “You knew I had a hard time trusting to begin with and when you finally gained my trust, you took advantage of it.”

Other victims accused Aday and his attorney of dragging out the legal process, furthering the women’s pain. None of the victims were identified.

The case began in October 2015, when one of the victims reported the crime. Aday was arrested Nov. 6, 2015.

He was originally held on suspicion of charges of rape, sodomy, penetration with a foreign object and sexual assault. The church terminated Aday the same month the allegations were reported to authorities.

The assaults occurred inside the church and on church property, elsewhere in Orange County locations and during church-sponsored trips to Costa Rica, Moldova and South Africa, according to the Sheriff’s Department.

A Mission Viejo man was convicted of murder on Monday after he drunkenly drove into a home and killed a 60-year-old man who was asleep in the front bedroom, according to the Orange County District Attorney’s office.

Kourosh Keshmiri was found guilty of one felony count of murder.

The 30-year-old was speeding in a residential neighborhood around 3 a.m. on Dec. 29, 2013, when he lost control of his car and crashed into the home.

Kenneth Jackson was sleeping in his bed when he was struck by the vehicle, later dying from his injuries, prosecutors said.

Keshmiri was traveling at a speed of 86 mph in a 25 mph zone when the crash occurred, according to prosecutors.

He was previously charged in a separate DUI case in 2013 and had a prior DUI conviction in 2010.

When Keshmiri was convicted in 2010, prosecutors warned him that he could be charged with murder if he killed a person while driving under the influence of alcohol or drugs.

Keshmiri faces a maximum sentence of 15 years-to-life in state prison.

Tustin Woman Charged With Drunken Driving, Crashing Into Orange Police Officer

A Tustin woman was charged with multiple felony counts on Tuesday after allegedly driving under the influence and crashing her car into a police officer who standing near his patrol car, according to the Orange County District Attorney’s office.

Ashley Victoria Bertolino, 27, was charged with one felony count of driving under the influence of alcohol and drugs causing bodily injury, one felony count of driving under the influence of alcohol causing bodily injury, and one felony count of driving with a blood alcohol level of .08% or more causing bodily injury, with sentencing enhancements for inflicting great bodily injury.

Three officers responded to a call for service in the 500 block of North Cambridge Street around 3 a.m. on Dec. 10.

One officer, identified as “Officer Doe” in a OCDA press release, was standing near the back of his parked patrol car at the scene when Bertolino allegedly drifted and struck him.

The other officers ran to assist Officer Doe, who was pinned underneath Bertolino’s vehicle, prosecutors said. He was taken to a hospital with serious injuries and remains hospitalized.

Bertolino is accused of having a blood alcohol level of .13 percent and being under the influence of drugs while driving 40 mph in a 25 mph zone.

She was detained at the scene and arrested the following morning after undergoing an evaluation at a local hospital.

Bertolino faces a maximum sentence of six years in state prison if convicted.

Woman Charged With Various Counts of Animal Abuse After Allegedly Abandoning Dog With 42-Pound Tumor in Newport Beach

A woman has been charged with various counts of animal cruelty after allegedly abandoning a dog with a 42-pound tumor at a Newport Beach animal hospital earlier this year.

Henry the golden retriever was said to have been found wandering alone in the sand on May 12 with a huge mass on his right side.

At least that's what the dog's owner claimed when she dropped him off at a veterinary hospital and never returned.

The tumor nearly doubled the dog's body weight, making it difficult for him to walk and relieve himself.

Henry was taken to Newport Beach Animal Control and underwent surgery.

The massive tumor was successfully removed and the dog is recovering well. The surgery was covered by donations. The 7-year-old dog appeared at a news conference Wednesday where Orange County District Attorney’s Office announced the charges.

Previous owner Sherri Haughton, of Newport Beach, has been charged with misdemeanor counts of animal neglect, failure to care for an animal, animal abuse causing life-threatening injuries and interfering with Newport Beach animal control officers' investigation.

Jennifer Malone of the DA's office said that in giving false information to the animal hospital, Haughton delayed the investigation into who had abandoned the dog and delayed the animal's crucial treatment.

She added that there was evidence that the previous owner had taken her dog to the vet and upon receiving information about his condition, Haughton did not obtain treatment for the pet.

Haughton was not arrested, but is scheduled to appear in court on Jan. 13. She faces up to two years in Orange County jail.

Henry has been placed with a foster family who is continuing to monitor his condition and he is receiving ongoing treatment.

“He’s a happy dog now that he’s received the treatment that he needs," said Nick Ott, an animal control officer with the Newport Beach Police Department.

Officials at the news conference said there are ways to care for pets if owners cannot afford to do so, including turning it over to animal services. The Orange County Society for the Prevention of Cruelty to Animals offers assistance for those who can't afford animal treatment and residents can donate to the city to help care for pets that go into the custody of animal services, officials said.
